Online booking of a stay in the accommodation of the gite « La Valériane »
TERMS AND CONDITIONS

Conditions applicable to all bookings
SUBJECT: firm booking of a stay accommodation in the gite “La Valériane”, 17 chemin des Chèvrefeuilles – F 06130 Grasse.
1 – The Parties are hereafter respectively entitled “HOST” and “TRAVELER”
2 – Provided that the booking has been accepted by the host, the fact of the traveler having read and declared accepted these terms and conditions, read the tariff (prices) and made an down-payment of the price of the stay, is worth signing a contract for the duration fixed by him at the price as fixed in the tariff-prices and the conditions as fixed hereafter.
3 – By booking the traveler blocks a minimum stay of 7 days.
4a – In the absence of a down-payment of a part of the price of the stay as fixed in the tariff-prices and not acceptance of the general conditions, the reservation will be considered as unconfirmed and the host may reserve the stay concerned for another renting.
4b – The balance is payable on arrival of the traveler.
5 -The payments may be made :
     – by Bank card on secure site (https and 3D secure) for the down-payment of the price of the stay as fixed by the tariff-prices,
     – by Bankcard on secure site (https and 3D secure) and by cash for the balance of the price of the stay as fixed by the tariff-prices.
     – by Bankcard on secure site (https and 3D secure), by cash, or by a check drawn on a French bank only for the guarantee.
6 – The contract is concludes intuitu personae and cannot be assigned to anyone else.
7 -The contract is established for a maximum capacity of 4 people and/or a baby crib model umbrella (provides by us for the latter).
8 – Nonsmoking gite. The butts are to be recovered by the traveler outside.
9 – Pets are not allowed. In case of non-respect of this rule, the host will refuse the stay. In this case, no refund will be made, the price of the stay will be due. The contract will be terminated to the wrongs of the traveler.
10 – The down-payment will be retained for any cancellation.
11 – Any cancellation that would occur less than fifteen days before the start of the planned stay, makes due the totality of the price of the stay. Any non-presentation makes the full price of the stay payable.
12 – In case of interruption of the stay by fact of the traveler, there will be no refund, the entire stay will be due.
13 – Except in cases of force majeure, if the host cancels the reservation less than eight days before the beginning of the stay, the traveler will be refunded the sums paid and he will receive a compensation equal to the paid deposit.
14 – Except in cases of force majeure, when, prior to the scheduled date of the beginning of the stay, the host is obliged to make a modification of the essential elements of the contract penalizing the traveler because these changes constitute a preponderant share of the services provided for in the contract and representing a significant percentage of the price honored by the traveler, the traveler may either cancel the contract and obtain without penalty the reimbursement of the sums paid; or accept the modification of the stay proposed by the host moderately a decrease in the price that he will propose. This price reduction is deducted from any sums still owed by the traveler and if the payment already made by the traveler exceeds the price of the modified service, the overpayment will be refunded before the beginning of the stay.
15 – Except in cases of force majeure, when during the stay the host is unable to provide a preponderant part of the services listed in the contract, representing a significant percentage of the price paid by the traveler, the traveler may either terminate the contract and obtain without penalty the reimbursement of an amount equal to the value of duration of the stay not yet passed, either accept a decrease in the price that the host will propose for the stay that remains to run.
16 – Host and traveler will draw up the joint entry and exit inventories on arrival and departure of the traveler. An indemnity covering the repair of any possible damage will be due to the host.
17 – The traveler is obliged to enjoy the places (inside and outside) as a good father. The cleaning of those places is the responsibility of the traveler during the stay.  The cleaning fees provides for in the tariff-prices only cover, after normal use by the traveler, the delivery in perfect condition of cleanliness for the entrance of the following traveler.
18 – An immediate and forced interruption of the stay will be the result of night and behavior noises. In those cases, there will be no refund, the entire stay will be due. (Decree of 9 March 2012 – art. R. 48-1 of the Code of Criminal Procedure)
19 – For your peace and in order to make the most of your stay, we give you the possibility to cover your civil liability towards third parties at the price of a modest contribution provided for in The page “Rates”.
20 – The parties (Host and Traveler) expressly agree that in the event of any discrepancy, the French texts will prevail, and that
in the event of dispute between the traveler and the host, the French Courts will be solely competent.
